Sales Contract & Health Guarantee

Please read the following carefully before joining our VIP wait list, making a deposit, or final payment.

• Buyer Responsibilities:

A licensed veterinarian must examine the puppy within (72) hours of purchase. If the puppy is shipped by vehicle, a licensed veterinarian must examine the puppy within (72) hours of arrival at the destination.

You may come to our facility and pick your puppy up. You may also choose a reputable shipping company. The price of the puppy does not include shipping. We can make suggestions on shipping companies. However, Petite Posh Puppies is in no way responsible for the health and well being of your puppy once the shipper has possession of your puppy. Petite Posh Puppies reserves the right to not release your puppy if we feel uncomfortable with the shipper. We would then discuss this with you and you can find another shipper or come pick the puppy up yourself.

Buyer is required to call and activate your puppies free 30 day Trupanion insurance prior to taking possession of your puppy.

Health Guarantee is only applicable to the original Buyer stated in this contract. If puppy will be changing ownership Buyer remains responsible to ensure puppy is spayed/neutered before ownership changes. Health Guarantee becomes void once original ownership changes.

PLEASE DO NOT TAKE THE PUPPY into public places unless absolutely necessary, until the puppy has had all its vaccinations to insure immunity against disease.

Buyer is required to provide proof that your puppy has been spayed/neutered by 12 months of age. Buyer shall be liable to the sum of $10,000.00 USD for every puppy produced from the stated puppy of this agreement. Seller may take further legal action to enforce this clause. Buyer shall be liable to the Seller for any attorney fees, court filing fees, service fees and any other fee related to enforcement of this spay/neuter clause. (Not applicable if breeding rights were sold to buyer).

Hypoglycemia (low blood sugar) is not a genetic condition and is susceptible to all toy breeds. Food should be given 2-3 times daily. Please closely monitor that your puppy is eating. If your puppy is refusing to eat try chicken and rice, cooked eggs, plain baby food, cream cheese, or cottage cheese. If you have noticed your puppy has not eaten in a full 24 hours you must take he/she to the vet immediately. Nutri-Cal should be on hand at all times with toy breeds. It is a high calorie product that can be rubbed on your puppies gums in the event of hypoglycemia.

• Seller Responsibilities:

The Seller warrants the puppy being adopted to be in good health at the time of sale and that the puppy has received all necessary, age-appropriate vaccinations and deworming. The puppy leaves Seller’s possession with a good bill of health.

We will provide an estimated adult size based on puppy weight charts. However, we cannot in any way guarantee size, color, earset, bite, or coat type at maturity, shedding, non allergenic, or physical/behavioral traits. These cannot be under warranty and are unpredictable due to the nature of genetics. The Seller does not guarantee ability of the puppy to show.

• Health Guarantee:

Each puppy comes with a Genetic Health Guarantee to the original buyer for the first 2 years. This Guarantee is only for genetic defects of the Heart, Liver, Kidneys and Lungs. This does not include colds, diarrhea, coccidia, allergies, stress colitis, hypoglycemia, hernias, external or internal parasites, etc.. It does not include accident or neglect, nor does it cover any disease after Buyer takes delivery of puppy. If Buyer’s vet exam reveals that the puppy has a life threatening disease or genetic defect (Seller reserves the right to a second opinion by a licensed veterinarian of their choice), the puppy will be exchanged for a puppy of equal value when one becomes available. The puppy must be returned at the Buyers expense. Notice of intent to return the puppy for replacement must be made within 24 hours of the Buyers vet exam. In the unlikely event that the puppy should pass away due to a genetic defect a Necropsy will be required stating the exact cause of death. If the cause of death was due to a genetic defect we will replace your puppy with a puppy of equal value when one becomes available (plus Seller will pay up to $300 towards the cost of the necropsy). Buyer to pay Seller difference in purchase price if the replacement Dog chosen is of higher value than original Dog. If these regulations are not met the Health Guarantee becomes null and void.

• Other important information:

Petite Posh Puppies are sold as PETS ONLY. We will consider breeding rights if desired, but this must be discussed and a formal breeding rights contract will be given.

We feed our dogs and puppies TLC Petfood. We have done thorough research on dog food and in our opinion this food proves to be among the most nutritious dog food available. It contains 3 different protein sources.. Lamb, Salmon, and Chicken. It also has veggies, fruits, antioxidants, probiotics, and prebiotics. We believe that TLC Petfood along with Nuvet gives our dogs and puppies the nutrition they need to live the healthiest life possible. We encourage you to keep your puppy on TLC Puppy until he/she is 1 year old. At that time you may transition him/her to TLC Whole Life or any other nutrition dense adult dog food.

The Seller reserves the right to refuse to sell a puppy at anytime.

If for any reason you cannot keep your Puppy, you may return (at Buyers expense) him/her to us and we will make sure he/she finds a good home. We DO NOT want our babies going to the pound or shelter.

It is understood that under no circumstance will Seller be responsible for any money spent on your puppies ongoing vet bills or care once in your possession.

If any legal action were to be necessary regarding this agreement or the puppy it refers to, by either Buyer or Seller, all action must be made and completed in Buford, GA.

The Buyer has read and fully understands the terms of this contract and agrees to comply.
